Fredericton officer on trial for impaired driving is back on the job

Const. Darrell Brewer is on "active administrative duty (desk assignment)," spokeswoman Alycia Bartlett confirmed in an email to CBC News.

"The details around his return to work cannot be commented on at this time," she said.

Brewer was charged withimpaired driving Aug. 23, 2015, after he was involved in a motorcycleaccident and left the scene.

His trial, which started in April, continued on Monday, with the Crown's expert testifying that Brewer's breathalyzer result indicated his blood-alcohol level was 150 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg.

Duringcross-examination, the defence arguedthe expert couldn't be certain Brewer was drinking at the time of the accident.

If Brewerhad consumed one pint (375 ml) of rum immediately followingthe accident, he would have blown the same level 90 minutes later, which is when the police caught up with him, the defence argued.

Drinking while not driving is not illegal, they told the court.

The trial resumes March13, when the defence will begin presenting its case.
