Bail hearing begins for accused killer Steven Neville

A bail hearing began Tuesday in St. John's forSteven Neville, who had his murder conviction overturned by Canada's top court last year.

Neville, 26, from Paradise, is again facing charges of second-degree murder in the death of Doug Flynn, 19, and theattempted murder of Ryan Dwyer in 2010.

A publication ban is in place, and covers any evidence presented in Neville's bail hearing.

The Supreme Court of Canada overturned Neville's murder conviction in November, after the same appeal was dismissed by theNewfoundland and Labrador Court of Appeal seven months earlier.

Neville pleaded not guilty to the charges against him in December.

Flynn and Dwyer werestabbedon Carlisle Drive, in asuburb area ofParadise, the jury was told the culmination of a feud that had been brewing between the three men.

Flynn was killed by a stab wound to the head.

Neville, who was sentenced to life in prison without a chance of parole for 12 years, contended that Justice CarlThompson's instructions to the jury to consider evidence related to the intent necessary for a murder conviction in comparison to manslaughter wasinsufficient.

Secondly, Neville saidThompson didn't properly answer one of threequestionsthe jury asked while deliberating.

Five Supreme Court of Canada justices agreed with Neville, and the conviction was overturned and a new trial was ordered.

Neville is being represented byMark Gruchy and Jeff Brace who have also taken onBrandon Phillips's first-degree murder casein the fatal shooting at the Captain's Quarters Hotel in 2015.

Since returning to the province from federal prison, Neville has been housed at Her Majesty's Penitentiary in St. John's.
