Traffic charges laid in Whitehorse pedestrian death

RCMP are not laying criminal charges in the death of a Whitehorse pedestrian whowas hit crossing Fourth Avenue last month but the driver is facing traffic offences.

William Lagimodiere, 69, died in hospital Feb. 26 from his injuries.

The driver's name has not been released.He has been charged with failing to yield to a pedestrian and driving without due care and attention.

The police said at the time the driver had not been drinking alcohol and was co-operating with their investigation.

"Through the investigation if there is evidence that leads us to believe that there is any criminal act involved then a criminal charge may be laid," said RCMP Cpl. JayWaldner.

"When, again through the investigation, if all the investigation points to one of the acts itself, in this case the Motor Vehicle Act, that's basically how we follow that. It's just strictly off the evidence."

A court date has been set for the end of April.
