MacIntosh sentencing delayed

There has been a delay in the sentencing of Ernest Fenwick MacIntosh, the former Nova Scotia businessman found guilty of sexually abusing two boys in the 1970s.

There has been a delay in the sentencing of Ernest Fenwick MacIntosh,the former Nova Scotia businessman found guilty of sexually abusing two boys in the 1970s.

MacIntosh, 67, was due to be sentenced Tuesday on 13 counts of gross indecency, indecent assault and other sex-related charges.

However, after the defence objected to a sexual assessment report,the hearing in Port Hawkesbury was postponed so the doctor who wrote the report can testify Sept. 28.

The maximum sentence for indecent assault is 10 years in prison, while gross indecency carries a maximum term of five years.

Three men accused MacIntosh of abusing them when they were between nine and 12 years old.

During the trial, MacIntosh testified he had oral sex with two of them but said it was consensual. He said it happened in the late 1970s when they were at least 16 years old and above the age of consent.

In July,Justice Simon MacDonald of the Nova Scotia Supreme Court found MacIntosh guilty of abusing two of his accusers two cousins whose identities are protected by court order.

MacIntosh was arrested in April 2007 near New Delhi, India, where he worked as a telecommunications specialist for 13 years. He was extradited to Canada two months later.

Hefaces a second trial on another set of charges involving three more complainants from eastern Nova Scotia.
