Delivery driver acquitted of manslaughter in death of Arby's manager

Rajdeepsinh Bihola has been acquitted of manslaughter in the death of a restaurant manager in Prince Albert, Sask., in 2022.

Bihola, a delivery driver at the time, got into an argument outside an Arby's with 31-year-old Allan Andres, who co-managed the restaurant.

The two men were arguing over a messed up drink order from the day before, and Andres started hitting and kicking Bihola, court heard.

Bihola did not fight back and got into his rental car, attempting to leave, but Andres was knocked to the ground by the car and hit his head, which caused a serious head injury and also a leg fracture.

Andres was taken to the hospital and died eight days later.

Police arrested and charged Bihola with second-degree murder in 2022, but he went to triallast month for manslaughter and was found not guilty.

Justice Gary Meschishnicksaid the Crown did not prove intent by the driver to assault the victim. He also noted a lack of physical evidence to support claims Bihola drove in a manner dangerous to the public.
